MPs to debate GST Bill in March
At the Dewan Rakyat
Reports by LEE YUK PENG, LOH FOON FONG AND YUEN MEIKENG

DEBATES on the newly-tabled Goods and Services Tax (GST) Bill 2009 will be held in Dewan Rakyat only next March to give every party enough time to scrutinise it, said Finance Minister II Datuk Seri Ahmad Husni Hanadzlah.

“With that, every party will be able to provide feedback on the Bill,’’ he said.

The Bill, among others, includes the Fund for GST Refund and various schemes such as on flat rate, warehouse and approved jeweller.

For those who make an incorrect return or understates any output tax, they are liable to a maximum fine of RM50,000 or three years’ jail, or both.

They are also liable to a penalty equal to the amount of tax which has been undercharged.

Any person who intentionally evades or assists anyone to evade tax is liable to a maximum fine of 20 times the amount of tax evaded or five years’ jail, or both, for the first offence.

For the second and subsequent offences, they are liable to a maximum of 40 times the amount of tax evaded or a maximum jail term of seven years.

If the tax sum could not be ascertained, the person is liable to a fine between RM50,000 and RM500,000 or a maximum jail term of seven years.

The Bill states that any person who attempts to obtain refund improperly is liable to a maximum fine of RM50,000 or a jail term of three years, or both.

The person is also liable to a penalty of two times the amount refunded.

The Goods and Services Tax Appeal Tribunal provides an avenue to appeal against the decision of the director-general.
